Terms of Agreement
Electronic Agreement: The following terms and conditions (“Terms”) constitute an agreement between Couture Rani LLC (“Couture Rani”, “we”, “our”, “us”) and you, the visitor (“you”, “customer, “visitor”, “purchaser”), governing access and use of all content and functionalities available at the Couture Rani website, through the www.couturerani.com (the “Site”).
Electronic Form: By visiting the Site, you are accepting and consenting to the practices described in the Terms. We may modify the Terms and your continued use of this Site following such change shall signify your agreement to be bound by the modified Terms.
Access and Retention: In order to access and retain these Terms, you must have access to the World Wide Web, either directly or through devices that access web-based content, and pay any service fees associated with such access. To retain an electronic copy of these Terms, you may save it into any program. We will notify you through this Site of any changes in the hardware or software requirements needed to access and/or retain these Terms that may create a material risk that you will not be able to continue to access and/or retain these Terms.
Eligibility
You must be at least eighteen (18) years of age or an emancipated minor to register as a Registered User of the Site or to use the Site or Services, absent the written consent of a parent or legal guardian. By using the Website, you represent and warrant that you have the right, authority and capacity to enter into this Agreement and to abide by all of the terms and conditions of this Agreement. In order to make a purchase on the Site, you must register on our Site and read and agree to be bound by our policies relating to all such services.
Registered User
You may become a Registered User of the Service at no cost. As a Registered User, you will have the ability to participate in all of the features and services available as part of the Services and site. When you register you are required to provide information about yourself that is true, accurate, current, and complete in all respects. Content and Intellectual Property Rights
“Content” is defined as any graphics, photographs, including all image rights, sounds, music, video, audio or text on this Site. Couture Rani tries to ensure that the information on this site is accurate and complete. Couture Rani does not promise that Couture Rani’s Content is accurate, error-free. Couture Rani does not promise that the functional aspects of the Site or Couture Rani’s Content will be error free or that this Site, Couture Rani Content or the server that makes it available are free of viruses or other harmful components. We always recommend that all users of the Internet ensure they have up to date virus checking software installed.
Your use of the Site and its contents grants no rights to you in relation to any copyright, designs, trademarks and any other intellectual property and material rights relating to the Content, including Couture Rani software and all HTML and other code contained in this Site. All such content, including third party trademarks, designs and related intellectual property rights mentioned or displayed on this Site are protected by federal and state laws and regulations and international treaty provisions. You are permitted to use the content only as expressly authorized by Couture Rani. Any reproduction or redistribution of the above listed content is prohibited and may result in civil and criminal penalties. Violators will be prosecuted to the fullest extent permissible under applicable law. Without limiting the foregoing, copying and use of the above listed materials to any other server, location or support for publication, reproduction or distribution is expressly prohibited.
Non-Commercial Use
This Site is for your personal non-commercial use only. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, commercially exploit, create derivative works from, transfer, or sell any Content, software, products, or services contained within this Site. You may not use this Site, or any of its Content, to further any commercial purpose, including any advertising or advertising revenue generation activity on your own Site. Illegal and/or unauthorized uses of the Site, including collecting usernames and/or email addresses of Registered Users by electronic or other means for the purpose of sending unsolicited email and unauthorized framing of or linking to the Site may be investigated, and appropriate legal action will be taken, including without limitation, civil, criminal, and injunctive redress. Use of the Site in any capacity as outlined above, must be with the permission of Couture Rani, which may be revoked at any time, for any reason, in Couture Rani’s sole discretion. All Registered Users and guest users waive and all claims of any kind resulting from termination or revocation of right to use the Site.
Account Security
You are responsible for maintaining the confidentiality of the username and password that you designate during the Registration process, and you are fully responsible for all activities that occur under your username and password. You agree to (a) immediately notify Couture Rani of any unauthorized use of your username or password or any other breach of security, and (b) ensure that you exit from your account at the end of each session. Couture Rani will not be liable for any loss or damage arising from your failure to comply with this provision. You should use particular caution when accessing your account from a public or shared computer so that others are not able to view or record your password or other personal information.
Order Acceptance
Couture Rani offers products that are ‘made-to-order’ by our participating designers and are subject to acceptance and availability. Once your order has been placed, you will receive an email acknowledging the details of your order. This email is NOT an acceptance of your order, rather a confirmation that we have received it. We reserve the right not to accept your order in the event that we are unable to obtain authorization for payment, that shipping restrictions apply to a particular item, that the item ordered is not reproducible or that you do not meet the eligibility criteria set-out within the terms and conditions.
Acceptance of your order will occur when we email you the Purchase Agreement confirming the details of your order. Once you have signed and returned the Purchase Agreement, either by digital electronic signature or manual means, your order will go into production. Please be aware that because of the “made-to-order” nature of the transactions on our Site you should expect a delay of approximately three (3) months between the date you place your order and the date that the Product is ready for shipment. The estimated delivery time will be indicated to you clearly at the time of order placement, therefore, please take this into consideration when placing your order.
Electronic Signatures: In accordance with Public Law No.: 106-229 (the Electronic Records and Signatures in Commerce Act) electronic contracts are given the same weight as those executed on paper. Thereby, any electronic signatures made in accepting any Agreements with Couture Rani will be held to the same burden and integrity as manually signed Agreements.
Order Changes, Cancellation and Availability
Any changes to the style, color and measurement of your order must be detailed in the area indicated on the Purchase Agreement. Once the Purchase Agreement has been received by Couture Rani, the order goes into production and cannot be changed or cancelled. Should you wish to cancel your order after you receive the Purchase Agreement please notify us of your cancellation by email at: HYPERLINK “mailto:orders@couturerani.com” orders@couturerani.com. You do not have to email us the Purchase Agreement if you are cancelling your order. Furthermore, we are constantly updating and revising our offering of products, and we may discontinue products at any time without notice. If your product has been discontinued after you have sent us your Purchase Agreement we will refund your payment in full.
Pricing Policy
Prices shown on the Site are in US Dollars and are exclusive of taxes. Please note that product prices are set at the beginning of each season using existing currency exchange rates. These prices are subject to change if the applicable currency exchange rate changes before your order is accepted, product discontinuation, manufacturer price changes, errors in advertisements, and other extenuating circumstances.
If you are a customer whose credit/debit card is not denominated in US Dollars, the final price will be calculated in accordance with the applicable exchange rate on the day your card issuer processes the transaction.
While Couture Rani strives to provide accurate product and pricing information, pricing or typographical errors may occur. Couture Rani cannot confirm the price of a product until after you place your order. In the event that a product is listed at an incorrect price or with incorrect information due to an error in pricing or product information, Couture Rani shall have the right, at our sole discretion, to refuse or cancel any orders placed for that product, unless the product has already gone into production. Yes, that would be fine. In the event that an item is wrongly priced, Couture Rani may, at its discretion, either contact you for instructions or cancel your order and notify you of such cancellation.
Unless the product ordered by you has gone into production, your offer will not be deemed accepted and Couture Rani will have the right to modify the price of the product and contact you for further instructions using the e-mail address provided by you during the time of registration, or cancel the order and notify you of such cancellation. In the event that Couture Rani accepts your order the same shall be debited to your credit card account. If we have to cancel the order after we have processed the payment, the said amount will be reversed back to your credit card account.
Payment Terms and Security
Terms of payment are within our sole discretion and, unless otherwise agreed by us in writing, shall be as follows:
At the time you place your order, you will be required to pay the full amount of the Product.
Payment will be debited and cleared from your account upon acceptance of your order by Couture Rani.
You confirm that the credit/debit card that is being used is yours or that you have been specifically authorized by the owner of the credit/debit card to use it. All credit/debit card holders are subject to validation checks and authorization by the card issuer. If the issuer of your credit/debit card refuses to authorize payment to Couture Rani, we will not be liable for any delay or non-delivery.
We take reasonable care to make our Site secure. All credit/debit card transactions on this site are processed using Authorize.net, a secure online payment gateway that encrypts your card details in a secure host environment. If you are a Registered User, we will securely store your credit/debit card details on our systems. These details will be fully encrypted and only used to process card transactions which you have initiated.
To help ensure that your shopping experience is safe, simple and secure, Couture Rani uses encrypted Secure Socket Layer (SSL) technology. Furthermore, we will take all reasonable care to keep the details of your order and payment secure, but in the absence of negligence, Couture Rani is not liable for any loss you may suffer if a third party procures unauthorized access to any data you provide when accessing or ordering from the Site.
Shipping Costs/Taxes and Duties
We are happy to offer free shipping for all domestic and international shipments. Currently that means we do not collect a sales tax to orders shipped within the United States. For delivery to any destination outside the United States no taxes or duties will be charged by us. As the recipient, you will be liable for all import duties, customs and local sales taxes levied by the country you are shipping to; payment of these amounts will be necessary to release your order from customs on arrival. Since duties and taxes vary by country and by what was ordered, we are not able to supply an estimated cost. Please check the latest applicable local requirements in your country before placing an order.
Return Policy
Due to the ‘made-to-order’ nature of our products no returns or exchanges will be accepted as they have been made to the customer’s specifications and are not resaleable. Therefore, all sales are considered final.
Faulty Goods
Goods are faulty if they are received damaged either in transit or due to manufacturing defect. Items that are damaged as a result of normal wear and tear are not considered to be faulty. Where possible, we will offer to repair faulty items or replace it for the same product in the same size, subject to availability. If it cannot be repaired or replaced you are entitled to a full refund.
Colors of Merchandize Disclaimer
While we have tried to accurately display the colors of products, the actual colors you see will depend on your monitor and may not be accurate.
Prohibited Activities
You use this Site at your sole risk. You agree that you will be personally responsible for your use of this Site and for all of your communication and activity on this Site. We reserve the right to deny you access to this Site, or any part of this Site, at any time without notice. If we determine, in our sole discretion, that you engaged in prohibited activities, were not respectful of other users, or otherwise violated the terms and conditions, we may deny you access to this Site on a temporary or permanent basis and any decision to do so is final.
You agree that you shall not remove, obscure, or alter any proprietary rights notices (including copyright and trade mark notices) which may be affixed to or contained within the Website.
You agree not to collect or harvest any personally identifiable information, including account names, from the Site, nor to use the communication systems provided by the Site for any commercial solicitation purposes.
Relationship
You acknowledge and agree that no joint venture, partnership, employment, or agency relationship exists between you and Couture Rani as a result of the Terms or your use of this Site. You agree that you may not and will not hold yourself out as a representative, agent, or employee of Couture Rani, and we shall not be liable for any representation, act, or omission on your part.

THIS SITE AND ALL CONTENT OF THE SITE ARE PROVIDED TO OUR CUSTOMERS AND PROSPECTIVE CUSTOMERS “AS IS” AND “AS AVAILABLE” AND WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THOSE OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE OR NONINFRINGEMENT.
LIMITATON OF LIABILITY:
IN NO EVENT WILL COUTURE RANI BE LIABLE TO ANY PARTY FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES FOR USE OF THIS SITE OR ANY OTHER LINKED WEBSITE, INCLUDING, WITHOUT LIMITATION, LOST PROFITS OR REVENUES, COSTS OF REPLACEMENT, BUSINESS INTERRUPTIONS, LOSS OF DATA OR DAMAGES RESULTING FROM USE OF OR RELIANCE ON THE INFORMATION PRESENT, EVEN IF EXPRESS IS EXPRESSLY ADVISED ABOUT THE POSSIBILITY OF SUCH DAMAGES.
Governing Law and Jurisdiction
These terms and conditions constitute the entire agreement and understanding between us concerning the subject matter hereof. These terms and conditions may not be altered, supplemented, or amended by the use of any other documents. The laws of the State of Delaware without regard to the conflicts of laws principles thereof, will apply to all matters relating to the use of this Website and the purchase of products. Each of us agrees and hereby submits to the exclusive personal jurisdiction and venue of the state and federal courts, where applicable, of the State of Delaware with respect to such matters.
